Terms of Service

1. Who we are

Human Sender ("the Service") is operated by Blustrix OÜ, a private limited company registered in Estonia (registry code 16864889), with registered address at Ahtri tn 12, Tallinn, 15551, Estonia. References to "Human Sender", "we", "us", or "our" mean Blustrix OÜ.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Human Sender does

Human Sender is a platform that allows registered users ("Senders") to attach cryptographic proof-of-authorship tokens ("Codes") to digital communications. Recipients ("Verifiers") can check a Code to confirm that a real, registered human sent a specific message at a specific time.

Human Sender provides identity assurance across four levels (0–4), each requiring progressively stronger verification steps. The level displayed reflects the checks completed at the time of registration or verification and does not constitute a guarantee of the user's identity or intentions.

3. Account registration

You must provide a valid email address to register. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

You may not create an account on behalf of another person without their explicit consent, or impersonate another individual or entity.

4. Acceptable use

You agree not to use the Service to:

• send spam, unsolicited commercial messages, or communications that violate applicable law;
• impersonate any person or falsely claim an identity, employer, or professional role;
• attempt to circumvent or exploit the verification system, including creating fake liveness checks or submitting fraudulent identity documents;
• use automated tools to generate Codes at scale without human involvement;
• harass, threaten, or harm any individual;
• violate any applicable law or regulation, including GDPR and anti-spam laws.

We reserve the right to suspend or terminate accounts that violate these rules, which also retroactively invalidates all Codes issued by that account.

5. Proof-of-effort Codes — limitations

Each Code is designed to prove that a registered Human Sender user consciously authorised a specific communication at a specific moment. Codes are time-limited (30 days for message codes; 2 minutes for live call codes) and intended for single use.

Codes do not constitute legal proof of identity. They represent the level of verification the Sender completed at registration, which may be as basic as email confirmation. Relying parties (Verifiers) should treat Code assurance levels appropriately and not use them as the sole basis for high-stakes decisions.

We cannot guarantee that all Codes were minted by the named person in every circumstance (e.g. if a device is stolen or an account is compromised). We are not liable for losses arising from reliance on Codes in such circumstances.

6. Verification levels

Higher verification levels (Level 2 and above) involve checks by third-party identity verification providers. We are not responsible for errors made by those providers. A verification level badge is accurate as of the date the check was completed and may not reflect subsequent changes to a user's circumstances.

7. Intellectual property

All content, design, code, and trademarks in the Service are owned by Blustrix OÜ or licensed to us. You may not copy, reproduce, or create derivative works from the Service without our written permission.

By uploading a profile photo or other content, you grant us a non-exclusive, royalty-free licence to display that content within the Service.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that the Service will be error-free or that any particular verification result is correct.

9. Limitation of liability

To the maximum extent permitted by applicable law, Blustrix OÜ shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including financial losses resulting from reliance on verification results.

Our total aggregate liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

10. Changes to the Service and these Terms

We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

We may modify, suspend, or discontinue the Service at any time with reasonable notice.

11. Termination

You may delete your account at any time by contacting us at legal@humansender.com. Upon deletion, your profile and all associated Codes will be permanently removed.

We may terminate or suspend your account immediately if you breach these Terms, without prior notice or liability to you.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Estonia. If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
